Lumberton Zoning Change Reviewed

Another stage in a battle over whether to allow small oil businesses in Lumberton industrial zones concluded last night much as it began.

The Lumberton planning board voted 5-4 to send a zoning-ordinance amendment allowing that use back to the Township Committee unchanged. The board reviewed the ordinance change after the Township Committee decided at a public hearing Jan. 19 that the amendment needed more clarification.

The planning board decided last night that concerns of neighboring Eastampton and Southampton officials and residents would be answered when site

plans for oil businesses were presented to the township.

The board first recommended the change in December, when the owner of Frank D. Smith Oil, which is now on Route 38, asked to move his home-fuel delivery business east to 29 1/2 acres where Route 38 becomes South Pemberton Road.

The board recommended the change because oil businesses are now prohibited throughout the township. Making the change would allow Smith to relocate his business, according to Sam Podietz board member and township committeeman.

John Harrington, an attorney for Eastampton Township, asked the board to withdraw the ordinance change because the industrial zone on South Pemberton Road abuts a residential zone in Eastampton, where homes on Dunham Lane are valued at more than $150,000.

It is up to the Township Committee to vote on the ordinance at a public hearing Feb. 16.
