Delco man gets 6+ years in child-porn case

A Delaware County man was sentenced to 78 months in a federal lockup this afternoon for distribution and possession of child porn.

Prosecutors said in court papers that David Devine, 35, of Chester Heights, distributed more than 1,700 images of children being sexually abused on his computers in August 2009 and that he had uploaded the images to a file-sharing website.

Some of the images depicted sadism and bondage, said defense attorney Joseph Fioravanti, in a court filing last month.

Devine also possessed more than 600 images of child porn in August 2010.

Devine pleaded guilty to the charges in November.

Fioravanti said that his client was not a predator and that there was no evidence that Devine, a former first-grade teacher in West Chester, had ever interacted sexually with any underage children.

He had sought a five-year mandatory-minimum sentence.

Assistant U.S. Attorney Michael Levy said that Devine, who also ran day camps at his home each summer for boys and girls, had been collecting child porn on his computers since 2006.

Prosecutors had sought a guideline sentence of 151 to 188 months.

U.S. District Judge Gene E.K. Pratter ordered Devine to surrender to the Bureau of Prisons on Thursday.
