After fatal car crash, Montgomery County shop owner charged with selling fake pot

SMOKING a synthetic pot called "Deadman" turned tragically prophetic for one Montgomery County motorist whose reaction to the illegal substance caused him to lose control of his car, resulting in a crash that killed two of his passengers and severely injured a third, according to investigators.

On Monday, Roger Malloy, 27, was charged with two counts of homicide by vehicle while driving under the influence and related offenses for the May 21 crash on State Street in Pottstown that claimed the lives of Rachael Witt, 15, and James Crawford, 28.

Meanwhile, a store owner, Mohammed Himed, and an employee, Rafie Ali, who allegedly sold the fake pot to Malloy and his friends were charged with corrupt organizations and drug offenses, according to the Montgomery County District Attorney's Office.

Malloy was with his brother and the victims when they purchased the synthetic marijuana, also known as K2, at the Achi Store on High Street, police said. When an undercover cop went in the day after the fatal crash and asked to buy two packets of the drug, the clerk pulled it from a hidden location under the counter, according to prosecutors. When authorities later raided the store, they reported finding 30 vials of K2, more than 30 crack pipes, 13 pipes used for smoking marijuana and a handgun.

K2 was banned in Pennsylvania last August, just two months after a young man took the drug and died after jumping off a four-story garage in Abington Township, prosecutors said.

Malloy told police he smoked the "Deadman" variety of K2 just minutes before the crash, and it made his heart beat fast, blurred his vision, caused a "sense of panic" and made him feel as if he was having an asthma attack, according to a news release from the D.A.'s office.

Still, after the crash Malloy and his brother had the wherewithal to pull Witt, Crawford and a third passenger from the vehicle before they left them for dead and fled on foot, police said.
