"I'd like to find out a lot more what happened here," Cooperman said.
Conditions inside the house in the 4800 block of North Ninth Street was discovered when Northwest Division detectives went there about 9 a.m. Aug. 8 to serve a warrant on Overton, 24, the children's mother, who had been charged with simple assault in a domestic incident involving Eldemire, 26, the children's father.
Once inside, the focus became the couple's three girls, ages 1, 3, and 4, who were dressed only in diapers and had no cribs or beds.
The three children were put in the custody of the city Department of Human Services for placement. Overton's lawyer, Emily Robb, told the judge the children were now with Overton's aunt.
Neither Eldemire nor Overton made any statement and their responses to the judge's questions shed no light on what happened inside the house.
Both strongly denied any drug use.
The prosecutor withdrew child-endangerment charges against both, and the assault charge against Overton. The plea agreement also includes a mutual stay-away order.
The couple have separated, their lawyers said.
