Joan Rivers ' daughter, Penn alum Melissa Rivers , filed a multimillion-dollar lawsuit yesterday against Yorkville Endoscopy, in Manhattan, and her mother's doctors, who she claims botched a routine outpatient procedure last August that led to Joan's death. The New York Daily News broke the story. Joan, a still-feisty 81, had gone to the clinic for a throat examination, but doctors did an unauthorized examination of her vocal chords, according to the News ' report on the suit.

BEING NO. 1 at the box office is Hobbit-forming. Peter Jackson 's Middle-earth finale, "The Hobbit: The Battle of the Five Armies," was the top movie in America this past weekend, making it three straight weeks. The film took in $21.9 million, according to studio estimates yesterday, narrowly edging out "Into the Woods" ($19.1 million) and Angelina Jolie 's World War II tale "Unbroken" ($18.4 million). The weekend's lone new wide release, the horror sequel "The Woman in Black 2: Angel of Death," landed in fourth place with $15.1 million.

Splitsville for Carter Helena Bonham Carter , 48, is back on the market. The Shakespearean marvel and her partner, fantasy auteur Tim Burton , 56, have split up after 13 years.
